The Role
You should have knowledge of the following: basic planning including will and trust preparation, providing counsel on avoiding probate, protecting assets from creditors and minimizing tax ramifications when transferring wealth. Complex wealth transfer techniques including GRATs, CRUTs, sale to IDGTs, and Dynasty Trusts in long-term or no RAP period jurisdictions. Post-death administration including probate administrations, Heggstad petitions, 13100 affidavits, 16061.7 and other required notices, trust administration and sub-trust funding, and accountings. Reporting gift and estate tax transactions, including preparation of Forms 709 and 706, valuation of assets, subtrust funding, GST tax issues, and basis of transferred assets. Counseling on tax-effective methods of charitable giving, establishment of charitable foundations. Litigation experience--including drafting petitions, responses, motions, discovery requests and responses, taking and defending depositions, and participating in mediations and trials--is a plus.
Requirements
You must have at least 7-9 years of experience primarily in high-end trust and estate planning, administration and litigation.
